EXEMPTION FROM TRAVEL RESTRICTIONS

 To Whom it May Concern:

Union Pacific Railroad Company (“Union Pacific”) is a Class I interstate freight railroad subject to the Interstate Commerce Act, 49 U.S.C. § 10101 et seq., and is part of the nation’s critical infrastructure as defined by 42 U.S.C. § 5195c(e), Presidential Policy Directive 21 (PPD-21) and the United States Department of Transportation. The Cybersecurity and Infrastructure Security Agency (“CISA”) , an agency in the Department of Homeland Security, recently issued a memorandum titled “Guidance of the Essential Critical Infrastructure Workforce.” In the Transportation and Logistics section of the memorandum CISA reaffirmed the federal law and national policy determination that the continued operation of the transportation industry generally and railroads specifically, is necessary for delivery of food, fuel, medicine, and other supplies that are vital to the nation’s ability to respond to the current pandemic emergency. I have attached a copy of the CISA memorandum to this letter for reference and additional guidance.

The bearer of this letter is a contractor of Union Pacific who is currently performing services that are essential to the health, safety, and security of the nation, and is therefore exempt from any local, state, and/or federal restrictions on travel or work outside the home imposed in connection with pandemic control measures. Accordingly, as a matter of federal law and national policy, you may not prevent, delay, or otherwise interfere with the performance of this individual’s duties for Union Pacific.
